CAR CLUBS RISK LEGAL CLAIMS FOR BAD ADVICE
Classic clubs that are giving out advice to owners unsure whether their cars are exempt from annual MoT tests are now being offered legal protection should their advice turn out to be incorrect. The Federation of British Historic Vehicle Clubs (FBHVC) said that the ‘loose’ nature of the guidance set out by the Department for Transport meant that clubs were advising owners, but that this could be contested by insurers. Communications director, Geoff Lancaster, said: ‘Many clubs are staffed by volunteers and they would need protecting from the legal action that might ensue if an authority or insurer disagreed on
whether or not a car should have been declared as a Vehicle of Historic Interest.’
